Chapter One: Introduction

1.1 Background of the Study
Inter-ethnic conflicts have been a recurring issue in many regions of Nigeria, particularly in areas with diverse ethnic groups such as Benue State. The Nigerian Constitution envisions peaceful coexistence among ethnic groups by guaranteeing the protection of rights, including the right to security and freedom from discrimination (Hassan & Salihu, 2023). In Makurdi LGA, ethnic tensions often arise due to land disputes, political rivalry, and competition for resources. This study aims to examine how constitutional law has played a role in resolving inter-ethnic conflicts in Makurdi, evaluating the effectiveness of legal frameworks and governmental interventions in mitigating violence and promoting peaceful coexistence.

1.2 Statement of the Problem
Despite the constitutional guarantee of ethnic equality and the prohibition of discrimination, ethnic conflicts continue to persist in Makurdi LGA, leading to loss of lives, displacement, and destruction of property. This study will assess the effectiveness of constitutional law in resolving inter-ethnic conflicts in the area, focusing on the roles of law enforcement agencies, the judiciary, and local government in implementing peacebuilding strategies.

1.3 Objectives of the Study

  • To assess the role of constitutional law in resolving inter-ethnic conflicts in Makurdi LGA.

  • To identify the constitutional mechanisms used to address ethnic violence and conflicts in Makurdi LGA.

  • To recommend strategies for improving the resolution of inter-ethnic conflicts through constitutional law in Makurdi LGA.

1.4 Research Questions

  • How effective is constitutional law in resolving inter-ethnic conflicts in Makurdi LGA?

  • What constitutional mechanisms are being used to address ethnic conflicts in Makurdi LGA?

  • What strategies can be employed to enhance the role of constitutional law in resolving inter-ethnic conflicts in Makurdi LGA?

1.5 Research Hypothesis

  • H₁: Constitutional law has played a limited role in resolving inter-ethnic conflicts in Makurdi LGA.

  • H₂: Ethnic conflicts in Makurdi LGA are primarily driven by socio-economic and political factors rather than legal challenges.

  • H₃: Strengthening constitutional and legal frameworks for conflict resolution will reduce ethnic tensions in Makurdi LGA.

1.6 Significance of the Study
This study will contribute to the understanding of how constitutional law can be utilized to address inter-ethnic conflicts, providing insights for policymakers, legal practitioners, and community leaders in Makurdi and beyond. The findings will offer valuable recommendations for enhancing the role of constitutional law in fostering ethnic harmony and reducing violence.

1.7 Scope and Limitations of the Study
The study will focus on inter-ethnic conflicts within Makurdi LGA, Benue State, with an emphasis on the role of constitutional law in conflict resolution. Limitations may include access to conflict data and challenges in obtaining cooperation from local communities and authorities due to the sensitive nature of ethnic conflict.

1.8 Operational Definition of Terms

  • Constitutional Law: The body of law derived from the Nigerian Constitution that protects citizens' rights and outlines the legal framework for governance.

  • Inter-Ethnic Conflicts: Conflicts between different ethnic groups, often arising from competition for resources, political power, or cultural differences.

  • Peacebuilding: Efforts to resolve conflict, promote understanding, and establish long-term peaceful coexistence among different communities.
